INDABA AND THE PRACTICE OF YOGA DURING PREGNANCY

As a provider of Services, such as yoga and pilates, Indaba is aware of the impact pregnancy can have on both the suitability of practice during pregnancy and a desire to continue practice (albeit likely at a different level).

Whilst Indaba's terms and conditions apply to Purchasers and/or Users of their Services and Facilities, whether they are pregnant or not, there are a number of conditions that specifically apply to pregnancy and a number of recommendations that Indaba makes in relation to the use of their Services and Facilities, when pregnant.

Accordingly, by way of example, Purchasers and/or Users of such Services and Facilities (whether at locations used by Indaba for the provision of Services or online), who are pregnant:

  1. are obliged to bring to the attention of Indaba staff members, Instructors, Teachers, Assistants to Instructors or Teachers and other providers of the Services they intend to use, that they are pregnant and the length of their pregnancy;

  2. are not, in any circumstances, permitted to use these Services and Facilities during the first 12 weeks of pregnancy;

  3. are not permitted to use these Services and Facilities where the Instructor, Teacher or other Service provider considers the Services they are providing should not be undertaken during pregnancy, irrespective of the length of the pregnancy;

  4. are not permitted to use the Services and Facilities where Indaba staff members, Instructors, Teachers and other Service providers, at their sole discretion, consider that such use may be detrimental to the health and safety of such Purchasers and/or Users;

  5. may only be permitted to use the Services and Facilities in a modified or restricted manner, where the Instructor, Teacher or other Service provider considers, at their sole discretion, the Services they are providing, should only be undertaken in such a manner during pregnancy;

  6. may not be provided with hands on assistance and/or physical adjustments, where the Instructor, Teacher or other Service provider considers, in their sole discretion, that they do not wish to provide such assistance or adjustments;

  7. must not participate in any Service, undertake any activity, or use any equipment unless satisfied that they are competent to do so, safely and properly;

  8. are obliged to safeguard their own health and safety and that of others when using the Services and Facilities;

  9. are obliged to bring to the attention of Indaba staff members, Instructors, Teachers, Assistants to Instructors or Teachers or other providers of the Services they intend to use, any medical condition (whether mental or physical) that may represent a risk to:

    1. themselves in using any Services and Facilities, including (but not limited to) engaging in particular activities or exercises and receiving hands on assistance or

    2. any other person using the Services and Facilities.

  10. are obliged to inform Instructors, Teachers, assistants to Instructors or Teachers or other Service providers that they do not want to undertake any activity, use any equipment or receive any hands-on assistance or adjustments, where that is the case;

  11. by entering the Facilities and/or commencing use of the Services and Facilities, are confirming to Indaba that:- i) they are in good physical condition and are capable of all forms of exercise (applicable to the activities they intend to undertake); (ii) such forms of exercise that they undertake will not, to the best of their knowledge and belief, be detrimental to their health and wellbeing; and (iii) they will modify any exercise they undertake to ensure that such forms of exercise will not be detrimental to their health and wellbeing.

  12. are obliged to consult a suitable medical practitioner if they are in any doubt about their physical condition and capabilities;

Without prejudice to the above provisions, Indaba encourages any Purchasers and/or Users of Indaba's Services and Facilities, who are pregnant, to discuss matters with Indaba staff members, Instructors, Teachers and other Service providers in order to ascertain, where possible, the Services that may be most suitable for their personal circumstances and the Instructors, Teachers etc. who may be best placed to provide such Services.

IMPORTANT. The purchase and/or use of Indaba's Services and Facilities are subject to Indaba Limited's terms and conditions and the provision of a Liability Waiver and Discharge by Purchasers and/or Users of Indaba's Services and Facilities (details of which can be found within Indaba's website and premises operated by Indaba Limited). The application of these terms and conditions and the terms of the Liability Waiver and Discharge (including those relating to pregnancy) are not in any way affected or reduced by the terms of this document.
